Instructions for student discipline in the faculties of the Ministry of Higher Education and Scientific Research no. 160 of the year 2007

The College of Dentistry in University of Basra is working so seriously towards putting into practice all standards of quality adopted by the Association of Arab Universities.

In his capacity as the primary beneficiary of the teaching and scientific outcomes of these instructions, the student is the key constituency in this domain. Therefore, both students and the College are required to commit to a set of mutual obligations, which include the following articles:    

Article 1: Student must commit themselves to the following:

Students’ Commitments according to the Student’s Discipline Law, no. 160 of 2007:

First: Students must comply with internal laws and regulations, instructions and orders issued by the Ministry Higher Education and Scientific Research and its Faculties.

Second: Students are bound not to prejudice religious beliefs, national unity or national feelings and is bound not to intentionally stir up sectarian, ethnic or religious seditions.

Third: Students are bound not to harm the reputation of the ministry or its institutions by word or deed inside or outside.

Fourth: Students must avoid all that is contrary to university behavior, such as high discipline and respect for management faculty, staff, fellowships and cooperation among students.

Fifth: Students are bound to commit to the proper disciplined behavior. The scope of the student’s commitment to such behavior will be noted down when the student, after graduation, applies for a profession, or is nominated for scholarships and fellowships.

Sixth: Students are bound to refrain from any action that disrupts the order and tranquility inside the university campus, or is considered contribute to disrupting order, inciting, or cover up those disrupting law and order in the university.

Seventh: Students are bound to maintain teaching requirements and the university possessions.

Eighth: Students are bound not to disturb the good conduct of the study in the college.

Ninth: Students must observe the college uniform, taking into account the specificity of each university or college alone.

Tenth: Students must avoid calling for joint activities that deepen discrimination or practice any category of political, religious or social persecution.

Eleventh: Students must avoid advocating for any political party, organization or national or sectarian group, be it in the form of attaching posters, signs, or photographs, or in the form of calling for forums and assemblies.

Twelfth: Students must avoid inviting party figures to give lectures or hold party seminars or religious propaganda in the university campus; otherwise, the national unity is violated.

Article 2: A student is punished to disciplinary notice penalty if he commits any of the following offenses:

First: Non-compliance with the uniform at the university.

Second: Violation of fellowship relations among students or verbal transgression against them.

Article 3: Student are punished to disciplinary warning penalty if they commit any of the following offenses:

First: Committing a notice punishable act after having been actually punished by warning.

Second: Disruption of the law, order and security in the university or college.

Article 4: A student shall be punished to 30-day dismissal if he commits any of the following offenses:

First: Committing a punishable act after having been punished to a previous warning penalty.

Second: Verbal transgression against any of the university personnel other than the teaching staff.

Third: Defamation of a member of the teaching staff, which harms him or her within the college or outside it.

Fourth: Placing stickers inside the Campus that disturb public order and morals.

Article 5: A student shall be punished to temporary dismissal from the university for a period not exceeding one academic year if he commits any of the following offenses:

1. When he re-commits one of the acts stipulated in Article 4 of these instructions.

2. When he practices or incites on sectarian, ethnic or political groupings or party inside the university campus.

3. When he assaults by action a member of the university personnel other than the teaching staff.

4. When he uses violence against any of the fellow students.

5. When he threats any with armed violence.

6. When he carries any kind of weapon, be it registered or not registered, inside the university campus.

7. When he intentionally or neglectfully causes a gross damage to the property of the university or college.

8. When he abuses national unity or religious beliefs.

9. When he verbally transgresses against any of the teaching staff inside or outside the college.

10. When he damages the reputation of the university by word or deed.

11. When he deliberately violates the proper functioning of the study.

12. When he is proven to have committed fraud on any of his fellow students or university personnel.

Article 6: A student shall be punished to complete dismissal by a university decision and shall be written-off if he commits any of the following offenses:

1. When he re-commits any of the offenses stipulated in Article 5.

2. When he assaults by action any of the teaching staff or the lecturers in the university.

3. When he commits a disgraceful act that violates morality and public morals.

4. When he submits any forged documents deliberately while he has already known that they were forged or when he is proven to be one of those helping or encouraging the others to submit forged documents.

5. When he is proven to have committed an act that violates security and tranquility inside the university campus and when he is proven to have participated in or helped the perpetration of such acts.

6. When he is proven to have been convicted of a felony or misdemeanor offense that is sentenced to more than one year detention.

Article 7:

First: New penalties will be imposed on students who have been previously punished for the violation of the Articles (2), (3), (4), (5) and (6) of these instructions when their new violations fall under the penal laws.

Second: If a criminal action is brought against a student for an act attributed to him outside the university, his case will be subjected to disciplinary consideration until a decision is taken on the criminal action.

Article 8: The Dean forms a student’s disciplinary committee under the chairmanship of the Assistant Dean and the membership of two other members of the teaching staff, provided that one of them be lawman, in addition to a representative of the (selected) union of students. One of the administrative officers is assigned to running the affairs of the committee’s decisions.

Article 9: No disciplinary punishment may be imposed unless it is recommended by the Disciplinary Committee.

Article 10: The disciplinary penalties decided in these instructions shall be imposed by a decision of the Board.  Then the Board has the right to authorize the dean of the college with the implementation of these decisions.

Article 11:

First: The notice penalties and the warning penalties are conclusive.

Second: Students dismissed from the college for a period not exceeding thirty days have the right to objection to the dismissal decision submitted to the College Board. The dismissal decision must be conclusive.

Third: Students dismissed from the college for a period not exceeding thirty days have the right to objection to the dismissal decision submitted to the President of the University. The dismissal decision must be conclusive.

Fourth: Students dismissed from the college for a period not exceeding thirty days have the right to objection to the dismissal decision submitted to the University Board.

Article 12: Students may object to the dismissal decisions mentioned the aforesaid second, third and fourth paragraphs of Articles 11 within seven days of the date of notification of the decision against him. When it has been impossible to notify the dismissed student of the decision, he will have the right to object within fifteen days from the date of publication of the decision of dismissal in the Notice Panel.

Article 13: Decision of penalty are placed on the Notice Panel for a less-than-fifteen-day period. The student’s guardian shall be informed of the decision in a written form.

Article 14: The Ministry of Higher Education and Scientific Research’s Instructions for the Discipline of Students no. 19 of the year 1989 are repealed.

Article 15: These instructions shall be implemented from the date of their publication in the official gazette.
